Terms and Conditions of Sale

These General Terms and Conditions of Sale (GTC) govern sales made on www.latelierdeschansons.com between:
The seller: L'Atelier des Chansons — assistance@latelierdeschansons.com The client: Any person making a purchase on the site.
1. Purpose
These GTC define the rights and obligations of the parties in connection with the online sale of personalized songs and digital musical services.
2. Services
The services are described on the website. Each service is subject to a precise description (style, deadline, delivery format). The audio excerpts and examples provided are illustrative and not contractual.
Each order results in the delivery of two versions of the same song — two interpretations of the same title within the same artistic direction. These two versions do not constitute two distinct creations. Any request aimed at obtaining two different styles or two separate concepts within the same order constitutes a new, separate order.
3. Prices
Prices are indicated in euros, inclusive of all taxes. L'Atelier des Chansons reserves the right to modify its prices at any time. The service is billed at the price in effect when the order is validated. No delivery fees apply, as the services are digital.
4. Order
Validation of the order constitutes full and complete acceptance of these GTC. L'Atelier des Chansons reserves the right to refuse or cancel any order in case of:
- incomplete or inconsistent information,
- suspicion of fraud,
- previous dispute with the client,
- payment default.
By transmitting a photo as part of their order, the client declares that they hold all necessary rights to this image and have obtained the consent of the persons appearing therein. L'Atelier des Chansons cannot be held responsible in the event of transmission of an image without the required rights.
5. Payment
Payment is due immediately upon order, by credit card, PayPal, or Apple Pay, via secure providers. No banking data is stored by L'Atelier des Chansons.
6. Delivery
Services are delivered by email to the address provided during the order. Deadlines are indicative and may vary depending on the complexity of the request. L'Atelier des Chansons cannot be held responsible for a delay due to missing information or exceptional circumstances.
7. Right of withdrawal — Exclusion
In accordance with Article L221-28 of the Consumer Code, the right of withdrawal does not apply to personalized digital content whose performance has begun with the express consent of the client.
By validating their order, the client expressly acknowledges:
- that the service is personalized and unique,
- that its creation begins immediately,
- and that they expressly waive their right of withdrawal.
8. Revisions and adjustments
L'Atelier des Chansons undertakes to make all necessary adjustments until the song matches the brief provided in the order. Adjustments must relate to elements explicitly mentioned in the initial form. Any new artistic direction not mentioned in the brief constitutes a new creation and will be subject to a new order.
Adjustment requests are accepted within 30 days of delivery. After this period, the order is considered definitively accepted.
Placing a new order while an adjustment is being processed constitutes acceptance of the previous delivery. No simultaneous refund request for multiple orders will be admissible.
Any payment dispute procedure initiated with the client's bank while an adjustment is being processed will be considered an abusive breach of contract. L'Atelier des Chansons reserves the right to produce all proof of delivery and exchanges as elements of defense.
9. Refund
No refund can be granted once the first version has been delivered. The only conceivable case is a total and definitive inability to deliver on our part.
The following do not constitute grounds for refund:
- subjective dissatisfaction with the artistic rendering,
- a request for evolution of the initial brief after delivery,
- an unfavorable opinion expressed after having benefited from several versions or adjustments,
- any request made simultaneously with a new ongoing order.
10. Intellectual Property
Once delivered, the personalized song is transferred to the client for personal, private, and non-commercial use. The client is free to listen to, share, and distribute it privately.
L'Atelier des Chansons reserves the right to use anonymized excerpts of creations for demonstration, communication, or promotional purposes, unless the client explicitly objects by email.
11. Applicable Law
These GTC are governed by French law. In the event of a dispute, an amicable solution will be sought first before any legal action.
